Phoebe Copas, 48, suspected of shooting an Uber driver in the head in El Paso, Texas, allegedly thinking she was going to be kidnapped and taken to Mexico, was charged Thursday with murder.

Uber driver Daniel Piedra Garcia, 52, was taken to a hospital, where he was declared brain dead and was on life support until he finally passed away yesterday.

Phoebe Copas was charged of felony aggravated assault causing grievous bodily injury, when she was visiting her boyfriend in El Paso prior to the shooting.

According to official information, the Tompkinsville, Kentucky woman ordered the Uber to take her to a local casino, where she planned to meet her boyfriend when he got off work, but according to her account, she "heard" traffic signals with the words “Juárez, México”, which allegedly led her to believe she was being kidnapped and would be taken across the border.

When the police arrived at the site, Copas was being helped by her boyfriend and had a pistol in her hands, according to the arrest documents.

Authorities explained that the place where the vehicle crashed was not was near a bridge, port of entry, or any other area with immediate access for travel to Mexico.

Following the Latino's death, charges against Copas were upgraded to murder and bail was set at $1.5 million.

The Piedra family will hold a vigil this Friday in El Paso to say goodbye to the father of the family, who had just returned to work after recovering from knee surgery.
