A new hearing announced in the federal court of Texas to defend DACA

The Mexican American Legal Defense and Education Fund (MALDEF) said it will once again defend the legality of DACA this Thursday, June 1, in a Texas federal court, which is evaluating a lawsuit filed by Republican states to end the benefit.
MALDEF lawyers have requested a hearing in front of Judge Andrew Hanen, who is handling a lawsuit filed in 2018 against the Deferred Action for Childhood Arrivals (DACA) program.
In July 2021, Hanen sided with the claimant states, led by Texas, who called for the end of the program, considering that the government of former President Barack Obama (2009-2017) violated the procedural law by establishing the program in June. 2012.

Although in his initial ruling Hanen left the program alive while the appeals process continued, he ordered that no new applications be accepted under this program, which stops the deportation of undocumented youth and allows them to obtain a work permit.
In October of last year, the Fifth Appellate District kept the program on its feet and returned the case to Hanen for a new decision “in light” of a new regulation issued by the Government of President Joe Biden in August 2022 to correct the Obama Administration's failure to establish the immigration benefit.
MALDEF lawyers said today at a press conference that they do not They expect Hanen to make a decision this Thursday. They also did not set a tentative date for when the magistrate would give a final decision on the program, which protects more than 580,000 immigrants.
Thomas Sáenz, president of MALDEF, today asked those covered by the benefit to continue renewing the benefit while a final ruling is reached.
He assured that if necessary they will go to the US Supreme Court in their fight to save profit.
