Undocumented immigrants at risk of ICE arrest and deportation

The Supreme Court's decision to block President Joe Biden 's deportation guidance endangers undocumented immigrants , who could be detained and placed in removal proceedings, even if they don't have a criminal record.

This was considered by several civil organizations that work in the defense of immigrants, who warned that the 5-4 decision of the judges of the High Court will only return fear to the communities.

“As we wait for the Court to take up this case, the agency's efforts to direct its limited resources in the best possible way will be disrupted, as families will once again fear the worst: separation, detention and deportation ,” warned Kerri Talbot, deputy director of the Immigration Hub.

Talbot defended the Department of Homeland Security (DHS) plan for the Immigration and Customs Enforcement ( ICE ) office to optimize the resources available to it through the deportation guide that was suspended, although the judges could take a final decision in December.

The Coalition for the Human Rights of Immigrants (CHIRLA) expressed “being alarmed” with the decision of the judges on the deportation priorities announced in September 2021, promoted by Secretary Alejandro Mayorkas .

“The ruling will encourage ICE and Border Patrol agents to continue harming our community,” he said.

Judge Samuel Alito launched the motion to block the deportation guide, although it was rejected by judges Sonia Sotomayor, Elena Kagan, Amy Coney Barrett and Ketanji Brown Jackson, who voted for the first time in a decision after taking office.

The DHS reported last June that ICE agents were not enforcing the guidance, after Texas Judge Drew Tipton ruled on the first block following a lawsuit from the Republican states of Texas and Louisiana.

In an express decision, the Court of Appeals for the Fifth Circuit had rejected a request from the Biden Administration and that opened the option of going to the Supreme Court, where he faced setbacks.
